Clemency and Parole - Post Conviction Relief Under UCMJ

After a court-martial, service members may request UCMJ clemency and parole to reduce their length of confinement and other punishment. Clemency is a discretionary action to remit or suspend the unexecuted part of an approved court-martial sentence. Parole is a conditional release. Clemency and parole submissions allow service members to develop and address additional evidence in mitigation and extenuation that was likely not presented during their court-martial.  Clemency is defined as an action to reduce the punishment.  Parole is generally defined as a conditional release from confinement before the mandatory release date.  Mandatory Supervised Release or MSR is similar to parole. What is a clemency?

Clemency is defined as an action to reduce the punishment. It is an action to remit or suspend the unexecuted portion of an approved court-martial punishment. This may include upgrading one's characterization of service, restoration of rights, reenlistment, or other relief. Mandatory Supervised Release or MSR is similar to parole. 3 identifying employment opportunities, 

4 obtaining transportation, and 

5 related matters.

What is a compassionate release?

Under some circumstances, it may be possible to obtain compassionate release. This is a separate relief in addition to UCMJ clemency and parole. This may depend on medical conditions and adequate medical care. Because prisons and confinement facilities are generally considered as punitive in nature, they may be unsuitable for medical treatment. Generally, an experienced military clemency attorney may provide additional information concerning this form of release.

WHEN SHOULD I START WORKING ON MY CLEMENCY AND PAROLE REQUEST?

It is best to start as early as possible with your UCMJ clemency and parole matters. Usually, it takes time to prepare a comprehensive and well-documented submission that addresses all factors that merit clemency and parole. There are also logistical challenges, different time zones, and other challenges. Usually, an experienced military clemency and parole attorney will be able to assist in quickly identifying important mitigation evidence and facilitating evidence collection.
